Terms and conditions of use

Art. 1. Object
These General Conditions of Sale (hereinafter "GTC") concern the sale of products carried out remotely via the internet on the website www.motostores.it belonging to Motostores di Innocenti Andrea.
The GTC will apply between the parties to the contract who are:
Seller: Motostores di Innocenti Andrea as identified above (hereinafter referred to as "Motostores");
Customer: the individual identified by the data entered when completing and sending the order form electronically with simultaneous acceptance of these General Conditions (hereinafter referred to as: "Customer").
Under personal data protection legislation, Customers are prohibited from entering false and/or invented names during the online order process and in any subsequent communications. Motostores reserves the right to report any violation or abuse to the competent authorities, in the interest and for the protection of consumers and public safety.
Furthermore, the Customer releases Motostores from any errors resulting from the issuance of incorrect tax documents due to incorrect or incomplete information relating to data provided by the customer, being the customer solely responsible for their correct entry.
These GTC apply to the sale of products displayed on the motostores website. The selling company reserves the right to modify these GTC at any time by notifying Customers through publication on the Website.

Art. 2. Online sales
An online sales contract is a distance contract, i.e., the legal transaction for the sale of "Products" entered into between motostores and the Customer within a distance selling system organized by motostores, which uses the Internet and related technologies for this contract. Therefore, these contracts will be concluded directly through the Customer's access to the website at www.motostores.it, where, following the indicated procedures, the contract for the purchase of the Product will be concluded.
For each product, a Technical Data Sheet is available on the Website containing the main characteristics and technical specifications of the same, as described by the manufacturers and/or importers.
The images and descriptions are taken from importers' and manufacturers' catalogs. Changes may be made during production and reported in subsequent updates. Motostores is absolutely not responsible for these possible changes.
It is understood that the image accompanying the Product's descriptive Technical Data Sheet may not be perfectly representative of its characteristics, but may differ in color, size, and accessory products shown in the figure, and may vary at any time without any obligation to provide prior notice on the part of Motostores due to changes made by manufacturers and/or importers.

Art. 3. Prices
The Customer may purchase only the Products offered on the site, at the price indicated therein in euros, excluding taxes and customs duties (shipping costs do not include international taxes and customs duties), by following the procedure indicated on the site. Correct receipt of the order is confirmed by the Company via email, sent to the email address provided by the Customer. This confirmation message will include the date and time the order was placed and a "Customer order number," to be used in any communication with Motostores. The message will contain all the information entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections.
The Company reserves the right, before sending the order confirmation, to request further information from the Customer via email regarding the purchase order placed on the Site.
List prices are subject to change according to the decisions of manufacturers and/or importers. Motostores will therefore update the prices online.
Any errors in published prices do not automatically imply acceptance of the order or shipment of the goods by Motostores. In this case, the credit card transaction will not be completed or accepted, and in the case of cash on delivery or other payment methods, the customer will be asked to accept the amount due.
Upon the Customer's explicit request, Motostores will issue an invoice for the shipped material and send it to the Customer. The invoice will be issued based on the information provided by the Customer at the time of ordering. Once the invoice has been issued, it will not be possible to make any changes to the information provided.

Art. 4. Product availability
In the event that the ordered Products are unavailable in stock after the Customer places the order on the website, Motostores will immediately notify the Customer at the email address provided. In this case, the transaction will be canceled.
In this case, any contractual or non-contractual obligation on the part of Motostores for failure to conclude the contract is excluded.

Art. 5. Acceptance of General Conditions of Sale
By electronically submitting their purchase order, the Customer unconditionally accepts and undertakes to comply with the GTC described in this document in their dealings with Motostores. They declare that they have read and accepted all the information provided to them, and further acknowledge that Motostores is not bound by different conditions unless previously agreed in writing.

Art. 6. Payment methods
Payment for the Products purchased by the Customer as well as the related delivery costs may only be made using the following methods:
- Credit card: For purchases made by credit card, upon completion of the online transaction, the relevant banking institution will authorize only the amount corresponding to the order placed. The amount for the purchased Products will be charged to the Customer's credit card only when Motostores processes the order.
In the event that the Customer exercises the right of withdrawal following payment for the Products purchased online, Motostores will instruct the bank to credit the amount to be refunded to the Customer's credit card.
The Customer must be the holder of a valid credit card at the time of ordering the Products purchased online.
At no point during the purchase process will Motostores be able to access the customer's credit card information, which is transmitted via a secure connection directly to the website of the banking institution handling the transaction. Motostores will not store this data in any computer archive. Under no circumstances will Motostores be held responsible for any fraudulent or improper use of credit cards by third parties when paying for Products purchased on the site.
- Bank transfer: if using this payment system, the Customer must transfer the amount indicated in the transaction, including shipping costs, to the credit institution indicated in the order confirmation email and before the contract is executed with the shipment of the goods.
- Online postal order: in the event that the Customer uses this payment system, the Customer must communicate the postal order code by email or fax to allow its liquidation by Poste Italiane Spa. Failure to do so
communication will not allow the transaction to be concluded and the subsequent shipment of the goods.
- Cash on delivery: in this case the Customer will pay upon receipt of the goods by paying the carrier.
- Ordinary postal order: using this payment method, the goods will be shipped only after the money order has been received by Poste Italiane SpA. The goods will be shipped only after the payment has been received.

Art. 7. Shipments
Purchased products will be shipped by Motostores to the address indicated by the Customer. Each shipment is delivered to the Customer via selected express couriers. Generally, without this entailing any obligation for Motostores and subject to product availability or any force majeure, the goods will be delivered to the courier within seven business days of Motostores accepting the order. Orders will only be processed if the goods are fully available. Upon receiving the goods at their home, the Customer must verify the integrity of the packages. It is the Customer's responsibility to have the courier note and accurately record any missing packages, under penalty of forfeiture of their rights in this regard. In any case, shipment constitutes delivery of the goods, which from that moment on are no longer available to the seller.

Art. 8. Product warranty
Products purchased on the website www.motostores.it are subject to the provisions, where applicable, of Legislative Decree no. 24 of 2.2.2002 (Official Gazette no. 57, 8.3.2002) on sales contracts and guarantees relating to consumer goods and, for anything not covered therein, to the specific provisions of the Italian Civil Code. This guarantee will apply to products with defects of conformity and/or malfunctions not detectable at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e., in accordance with its intended purpose and as provided in any technical documentation, in compliance with the various operating instructions indicated therein.
The aforementioned warranty will not be applicable in case of negligence or carelessness in the use and maintenance of the product.
Any non-conformity of the products must be reported within the terms established by law and communicated by email, fax, or registered letter.
Even if the product is non-compliant, it must be returned to Motostores for repair or replacement complete with all packaging and all accessories and documentation received by the customer at the time of purchase. Returning the product without the original packaging, accessories, and documentation will prevent Motostores from replacing the product at the manufacturer's premises and will make the replacement impossible. In any case, the return must be communicated and agreed upon with Motostores, which must be informed of the return procedure, including the courier and any tracking number. Returned goods travel at the Customer's risk until they are delivered to Motostores. Motostores reserves the right to verify the actual defect reported by the Customer and to repair or replace only after such inspection. If, following the manufacturer's inspection, the defect is not found to be a lack of conformity, the Company reserves the right to charge the Customer for the costs of verification and repair, as well as any related shipping costs.

Art. 9. Right of withdrawal
Purchases made on the website www.motostores.it are governed by Italian law on mail order sales. If the Customer makes a mistake in the order and receives an unwanted item, they have 10 (ten) days from the delivery date to exercise their right of withdrawal, or the option to return the product. Pursuant to Articles 64 et seq. of Legislative Decree 206/2005, the Consumer Customer, i.e., a natural person acting for purposes outside of their business, commercial, artisanal, or professional activity, has the right to withdraw from the purchase contract for any reason and, consequently, has the right to return the purchased item and obtain a refund of the amount paid, in accordance with the procedures indicated below.
The right of withdrawal is subject to the following conditions:
a) the right applies to the product in its entirety and not to parts or components of it;
b) In the event of prize promotions or combined promotional sales, in which the purchase of one item is combined with another item sold at a negligible price (or given away), the right of withdrawal will be legitimately exercised by returning both purchased items (given the accessory nature of the promotional item compared to the first). To exercise the right of withdrawal, the Customer, without the need to provide explanations and without any penalty, must send a communication indicating the intention to withdraw from the contract within 10 (ten) working days of receiving the item.
Motostores is not responsible for damage or theft/loss of goods returned via uninsured shipments. Motostores will refund the price of the item for which the customer exercised the right of withdrawal, provided that the item is intact and unused.
Except for any costs for repairing damage, Motostores will refund the full amount paid by the Customer at the time of purchase of the goods, within 30 days from the date on which Motostores became aware of the exercise of the right of withdrawal, provided that in the meantime the goods have been shipped according to the methods indicated above, by crediting the amount to be refunded to the Customer's credit card.
The right of withdrawal automatically lapses in cases where the following is ascertained:
a) the lack of the original packaging and/or wrapping;
b) the absence of all the integral elements of the item (accessories, tags, labels, information notes, etc.);
c) damage to the product for reasons other than its transport;
d) the use of the product;
In the event of forfeiture of the right of withdrawal, Motostores will return the purchased item already in its possession to the sender, charging the latter the shipping costs.

Art. 10. Information and complaints
Any clarification, information on assistance services or any complaints may be requested or submitted to Motostores at its registered office as highlighted above and by email to the following addresses: informazioni@motostores.it
The information contained in the GTC and on the website for individual products is communicated in its entirety through these conditions and through the information sheets pursuant to and for the purposes of Articles 52 and 53 of Legislative Decree 206/2005.
